Citizens Property Insurance Claims

Florida legislators have passed laws which have made it difficult, if not impossible, to retain a public insurance adjuster to assist a Citizens policy holder with their insurance claim. Until the legislature changes these laws, you may need to retain an attorney such as James C. Ligman P.A. who specializes in insurance law, to assist you with settling your claim.

Created in 2002 from two existing state-backed insurance pools, Citizens Property Insurance Corporation is now Florida’s largest residential property insurer. Unlike other insurance companies, Citizens is a non-profit company, run by an eight-person board of governors appointed by the Governor and other Florida officials.

The Florida Legislature voted to make Citizens Insurance compete with private homeowner insurance companies and to allow Citizens to sell insurance to businesses in Florida. As the state-backed insurer, Citizens can charge all Florida property and automobile insurance policyholders with assessments to make up for deficits after catastrophes.

Unfortunately, the lobbyists for the insurance industry have persuaded Florida legislators to pass laws which are unfriendly to the consumer. The legislature felt it necessary to protect consumers by placing restrictions on public insurance adjusters who handle Citizens claims. These restrictions have made it difficult, if not impossible, to retain a public adjuster to assist the insured with their initial claim. All of this has occurred, in spite of the fantastic results obtained by public adjusters. In claims filed by public adjusters, insureds generally obtain a greater recovery than if the insured presented the claim on their own.

Until the legislature sees the light or the laws prohibiting insureds from contracting with public adjusters are ruled unconstitutional, we are here to assist you with your claim. We will work with estimators, contractors and appraisers to obtain the greatest recovery possible. Naturally, when public adjusters are once again able to handle Citizens claims, we are available to assist when litigation becomes the preferred avenue.
